DMCA Notification and Takedown Policy

Novel Hut respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). This policy outlines the procedure for copyright holders to request the removal of infringing content and for users to respond to such requests.

If you are a copyright owner or their authorized agent and believe that content on Novel Hut infringes upon your copyright, please submit a DMCA Takedown Notice as described below.

1. How to Submit a DMCA Takedown Notice

To be valid, your request must be in writing and include the following information:

  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • A description of the copyrighted work that you claim has been infringed.
  • The location of the infringing material: Provide the specific URL(s) on Novel Hut where the infringing material is located.
  • A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement of accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

2. What Happens After a Notice is Filed?

Upon receipt of a valid DMCA Takedown Notice, Novel Hut will:

  • Act expeditiously to remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content that their material has been removed as a result of the notice.
  • Provide the user with a copy of the takedown notice and instructions on how to file a counter-notification.

3. How to File a DMCA Counter-Notification

If you believe your content was removed by mistake or due to misidentification, you may file a counter-notification. To be valid, your counter-notification must be in writing and include:

  • Your Contact Information: Your full name, mailing address, telephone number, and email address.
  • Identification of the removed material and the URL where it was located before it was removed.
  • A statement of good faith belief: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your electronic or physical signature.

4. Repeat Infringer Policy

Novel Hut has a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright.
